What is a rent agreement?
A rent agreement — also called a tenancy agreement or rental contract — is a written contract between a landlord and a tenant setting out the terms on which a property is rented. It records the rent, security deposit, length of tenancy and the responsibilities of each side, turning a casual arrangement into a clear, enforceable understanding. In Pakistan a written rent agreement is the standard for both residential and commercial lettings and is often required for utility connections, tenant registration with local authorities, and resolving disputes.
When do you need one?
You need a rent agreement whenever a property changes hands for rent — letting a house or flat, or renting out a shop or office. Both sides benefit: the landlord has a record of the rent, deposit and the tenant's identity, while the tenant has protection against arbitrary rent increases or eviction within the agreed term. In many Pakistani cities, landlords are also required to register tenants with the police, and a written agreement is part of that process. Agreements are frequently made for an 11-month term, which is renewable on mutual consent.
Format & what to include
A rent agreement opens by naming the date and place, the landlord and the tenant (with CNIC and addresses), and a description of the property and its permitted use. It then sets out numbered clauses covering the key terms: the tenancy term and start date, the monthly rent and when it is due, the refundable security deposit, any agreed annual increase, who pays utilities and maintenance, restrictions on subletting and unlawful use, the notice period for termination, the landlord's right of inspection, and the handover of vacant possession at the end. It is signed by both parties and, ideally, two witnesses; for stronger legal standing it can be executed on stamp paper and notarised.
Frequently asked questions
Why is a rent agreement usually for 11 months?+
An 11-month term is a common convention because agreements under one year are simpler to handle and renew, and avoid some longer-tenancy formalities. The agreement is typically renewable by mutual consent, often with an agreed rent increase.
Should a rent agreement be on stamp paper?+
For everyday lettings a clearly written and signed agreement is widely used. For stronger legal protection, especially for higher-value or commercial properties, executing it on judicial stamp paper and having it notarised is recommended. Check your local requirements.
Is tenant registration with the police required?+
In many Pakistani cities, landlords are required to register their tenants with the local police, and the rent agreement plus tenant CNIC are part of that process. Requirements vary by city, so confirm the rules in your area.
What happens to the security deposit at the end?+
The refundable security deposit is returned to the tenant when the tenancy ends, after deducting any unpaid rent, outstanding utility bills, or the cost of repairing damage beyond normal wear and tear.
